Not only has she contracted the diseases, but she has had to have partial vulvectomy which left her disfigured, and has more surgeries to come as a result. It has interfered with her work, and will affect her for the rest of her life. Husband had years of experiences with prostitutes from China and Japan during travels, and is currently having an affair with another woman. Think she will win the judgement? I think she has a good shot, and he is wealthy enough where that 25 million will be a pittance. Of course, in the divorce she will also get half of everything. She is wealthy on her own as well, but I can wholly understand why she would sue him. In terms of more low-profile affairs, should spouses be able to sue for diseases picked up from infidelities?

If they find that this woman KNEW that her husband was a slut, that he was screwing everything in town and that he had previously had STD's, it's not likely she will be awarded much because she had sex with him despite her knowledge. People must take responsibility for what happens to them. If a woman has sex on a routine basis with a man who seems to be totally faithful to her, then if she gets an STD and he tests positive for it, a jury will have to be convinced that HE gave it to HER and SHE didn't give it to HIM. With everybody screwing everybody these days, cases like this aren't easy.

pelicanpreacher Posted August 17, 2008 Posted August 17, 2008 The crutch of this case still hinges on her proving that she didn't contract these STD's through an infidelity of her own. I see a lot of finger pointing in this situation. I also agree that the law requires one to mitigate their risk of damage(s) by avoiding such activity that may cause themselves injury, damage their property, or lose money.
almost famous Posted August 17, 2008 Posted August 17, 2008 I don't know if she can prove the HPV one cause men can pick that one up in the locker room. Also, he could have had HPV even before they were married, it is so common.
RecordProducer Posted August 20, 2008 Posted August 20, 2008 Oh, c'mon, Trichomonas can be cured with antibiotics in 7 days and HPV is something that 2/3 of women have. It's not like she contracted AIDS or Hepatitis B or C.

She probably had HPV before they even married.. This is IMO solely for revenge.. bitter revenge..
swansong519 Posted August 20, 2008 Posted August 20, 2008 As Tony eluded to...She may have a case with the first std if it could be proven that it was her husband that gave it to her...but after contracting it she assumedly continued to have sex with her husband...thus absolving him of responsibility since she didn't mitigate her potential damage. It's like if I accept a cheque from you and it bounces...well I have avenues available to me to reclaim my money from you. If after the first time I continue to accept cheques from you, I'm on my own.

I actually like the idea of a spouse suing the other one for contracting an STD, because it could happen to anyone. What if your child told you one day that they're dying because their dear wife/husband screwed someone on the side? Hell, it should be taken care of by the law! I just think that this particular case is so much on the edge of being ridiculous, that it threatens to ruin the whole idea and create a precedent that will favor the cheating side in all other cases.
