Hello everyone!

 

Have a question in this situation: Mother lives in Europe, Father lives in the USA. If a custody order such as a child is required to spent 1 month in the US with his father but a mother does not allow him to go (due to the fear that that father will not return this child, as he already stated), what are the implication to the mother for not following the custody order:

(1) She will get in jail (?) ONLY when and if she crosses the US border?

(2) Can father report the mother to FBI for a search (and she will be picked up at any major international airport) similar to the child abduction situation?

First step is to engage an attorney familiar with international custody cases.

 

If the country is a Hague Convention signor, there may be redress through the US State Department.

 

The sticky wicket is the child is abroad already and being "retained". Sometimes, depending on circumstances, a reverse abduction is appropriate. A lawyer can advise on the risks.

 

There are legal forums on the internet where such questions might be more appropriate.

 

Adding, if you are the mother, the above still applies, but you have to weigh the risks of someone coming after you and the child. IMO, it's better to follow the law and use it to enforce your custody agreement. :)
