has anyone ever thought about leaving and not paying your half of rent or morgatge. Or is this wrong, even when the spouse won't leave

Yes, it's wrong to not pay your obligations, but people do it.

 

You could be messing up your credit or worse if your spouse cannot afford to make up the rest. It could result in his eviction or foreclosure, and if you are also listed that affects you financially and legally.

You can leave and inform the landlord that you're doing so but if you have a lease or mortgage you are legally bound to see to it that it gets paid. That means all of it. The accounts don't deal in halves. You could pay your half but would he? If he didn't you could still end up with a foreclosure or eviction on your credit record.

 

You best bet may be to at least consult with an attorney.
