Cobra is medical coverage that extends for up to 18 months after your employment ends. It is coverage under your former employers plan - so you need to contact the employer to find out about it.

Did you STBX lose his job? If not it is unlikely you qualify for Cobra. Are you looking to continue your medical coverage after your divorce? I would think that unless it is worked out in the divorce agreement, that he must continue to provide medical coverage, you must get your own.

 

But I am not an expert on this stuff. If you are still married, you might be able to speak with the insurance carrier directly - as you are covered by their policy - but again unlikely you can get coverage under Cobra.

Have you spoken to an attorney? You have been married a long time in the eyes of the law. He may have to provide you with the life you've been accustomed to.

 

You should really speak to an attorney who practices Family Law.

im seeing one today....he only makes about 45,000 a year,we are in debt,have a mortgage and I will need alimony to even survive....He has been in an affair for the last 7 years,is engaged to her,and he is bitter because I caught them.My car blew up the day before he left and Im a wreck.....say a prayer for me please....

I'm sorry things are so bad for you right now. Hopefully your lawyer will have some good things to tell you about your situation. Things you may not even have been aware of. If nothing else at least you won't feel as though you're going through this alone because you'll have someone by your side.

You need to seek the legal council of an attorney. There is so much that you don’t know, that things may seem much worse than they actually are.

 

For example ... a lot of folks don’t know about this, but it might help to cheer you up a little since it looks like you’ll qualify in another year:

 

If you have been married for at least 10 years and don't remarry, you can qualify for Social Security benefits based on your ex-spouse's earnings when you both reach age 62. That is the case even if he has remarried or hasn't yet retired and begun to receive benefits himself.

 

But you are entitled to receive 50 percent of your husband's Social Security benefits as an ex-wife. Keep in mind, though, that if you qualify for benefits based on your own employment history, you'll receive the larger of the two payments.

Enigma did a good job. She sure made me feel better for you. I am not positive about this but I think SS recipients can qualify for Medicare which is medical insurance.

 

It can't hurt to ask.

Thanks everyone...My husband is only 571/2 and I dont think he qualfies for ss until he is 66...but I will ask all these questions today....

May not matter since YOU will be:

 

... hasn't yet retired and begun to receive benefits himself.

 

I’d also ask my attorney about a non-modifiable clause regarding and spousal support you receive. Especially at your age, it will be difficult to find adequate employment. This way, he won’t be able to petition the court at a later date and lower his support payments to compensate for the additional SS income you receive. With both checks coming in, it will better your chances of being able to financially provide for yourself.

You are eligible for COBRA. As one who has dealt with insurance and HR, I am quite certain that this will apply to you. Remember, it is not cheap, but it is much less than not having coverage.

I think a local women's support group in your area can be of more assistance to you. I do think you can relax when it comes to insurance. You should be covered for 36 months under COBRA.

You guys are great,thanks for all the info.My lawyer wasnt much help as we are just answering the original complaint.I filed in Nov,he came home,we canceled it and a week later I caught him and then he filed.

 

He will find out about my rights with the SS.

I think because there isnt much money,I cant expect much.And your right about employment being unable to get especially with my health problems.

 

James ,being involved in insurance and HR do you know anything about who is allowed to call in prescritions for people? Can a Marketing Director of a small hspital call them in,without the person seeing any doctors?

This is a medical question, and even as I give my opinion, I am not a medical professional.

 

As far as I know, a person always needs a doctor to sign a prescription for a pharmacy to fill it. Can a Marketing Director of a hospital get a doctor to sign a prescription? I suppose that is possible.
