2. And why can the BS sue the OW / OM, but not the spouse? I would think the spouse would be sued--not the OW / OM.

 

1. What would they counter sue for? In my state, there is nothing they could counter sue for. The law sees the OW/OM as guilty if they interfere with a marriage and have sex with a married person. If they are on the wrong side of the law, what could they possibly sue for?

 

2. The spouse isn't sued, because the laws are written for third party interference. The most a BS can do to a spouse is divorce him/her.

No they should not be able to sue because the ultimate blame is to the cheating spouse. Why is it that the cheater is treated as if they were governed by some overwhelming force that made them cheat? It seems that everybody gets the blame except the person that actually is at fault. I don't believe in lawsuits or jailtime or any of that but I think all betrayed should be able to walk away while keeping the house and not having to pay a dime in any alimony or spousal support. Cheaters should not be rewarded in divorce court.

The above makes me glad I live in a (reasonably) civilized country, that expects adults to deal with personal situations in a adult manner

 

Oh...you mean like rather than dealing with your husband like an adult, you go out and cheat on him? That kind of adult manner?
