danis Posted September 1, 2007 Posted September 1, 2007 Would someone please educate me on the process of divorce. I have a couple of friends that have decided that they want a divorce. However each one is waiting for the other to file the papers and get a lawyer. Does it matter which person files for the divorce? He was thinking about buying her share of the house, how does that work? and what is the difference between legal separation and divorce besides the fact that you are free to marry again.

Is it true that you have to be living separate for more than a year before filing for divorce? Also would living in a house with a smoker constitute abuse? When this is the main cause of disruption of the marriage? How about the fact that they have not had intercourse in a couple of years? Is is better to get legal councel, or is it ok to file on your own.
Hurt & Alone Posted September 2, 2007 Posted September 2, 2007 I will have to agree with LB it all depend on the laws that rule in your location. Did he smoke in the beggining of the rel/marriage? Not sure how this causes a divorce as far as no sex....well that could be a problem but usually a problem that can be resolved through communication or counseling.
Author danis Posted September 2, 2007 Author Posted September 2, 2007 She's the smoker and yes she smoked prior to marriage but this has caused most of the friction within the marriage as he continually struggles with it. The house is filled with smoke and he hates it. Asks her all the time to please smoke outside and she refuses. Her reply is, "if you don't like it you can leave". If I can't smoke in my own house than we should sell it. Does anyone else have any info on Canadian Divorce Laws?
