Angry How long is the divorce process?

Does divorce take a long time to process? My ex-hub supposedly said that he went to the lawyer back in May to file and alright signed while I'm still waiting to offically sign the paper. The divorce is uncontested so there's no problem on who's getting what because there's nothing to fight over. On top of that, he's got a new serious girlfriend that he's planning to move in with while I have a boyfriend that is beginning to become serious. I want an offical end to this but does this have to take this long? I mean when my parents got divorced a couple of years ago, it didn't take a while eventhough they were fighting over things (the house, the car, money, etc.) Help!

That depends on what state you live in. He filed for divorce -- is that correct? It could take a couple of months to get your case on the court's docket, but you should have a date by now, unless the action has not been filed. If so, have you been served with a complaint? Don't you have a lawyer to advise you? If not, you a least need a lawyer to review the divorce papers. It would be foolish for you to sign anything until you've done this.

I haven't been served with anything yet. That's what I'm getting pissed off! He said "it's already been send" but I was never served with the papers. Once I get the papers, I'm gonna go to the same laywer who helped my mom during her divorce from my dad and figure something out. I mean there is nothing to be contested with however, I do want to read it carefully and have the advice from my laywer.

Another thing I'm concerned about is that I'm moving in a few weeks and so is he. I wanted to be served before I move so it won't be much of a mix up when I move.

I would say no more than 3 mos total from file date to "D" day. I did it myself w/o lawyers and that was the quickest I think.

Call his lawyer maybe and see if he indeed has been filed.

BTW when I was getting divorced the circumstances were exactly the same, down to the new loves.

Good luck You should of been served already awhile ago.

My ex did the same ***** to me, that's why I had to end up filing.

Yeah, I think if he really did file, you should have already been served with papers. My MM filed and they told him she'd be served 7 - 10 days from the date he filed.

I've read quite a bit about divorce in Texas. One party files, the other is served with papers. The second party has a limited time to get those papers signed and turned back in. Then there's a 3 month "cooling off" period before the case goes to court.

I live in Texas (Houston) and recently did my own divorce since me and my ex didn't have anything to divide (property or kids). I went to Barnes and Noble and got the How to Do A Texas Divorce (Uncontested) and put the CD Rom in and just filled out the forms - went down to court house and filed in April. Had to wait the mandatory 60 day waiting period.

On day 61 to be exact I was at the courthouse and first person on the docket. Got divorced and was done with it. It was easy and painless.

Well, it's easy for most of you since that was done in Texas. I'm in New York. I've been trying to contact my ex but he seems to always been either too busy to answer his phone or just want to plain ol' ignore me when I told him to keep me posted until the divorce is finalized. I mean, even after we broke up, we're supposedly friends. I'm not sure if he and I will remain friends after this because I have no ounce of trust for him anymore (not even as a friend). I sometimes feel sorry for his new girlfriend because she would now have to put up with his BS all the time. That's the reason why I left him because all he does is lie and maniuplate me. And now he's doing this again. He knows that after this, I'm going to be completely happy but he doesn't realize he won't be free until I get that paper. He told me they sent 2 weeks ago but guess what..... NO PAPERS!

Check in with his lawyer (or have your lawyer check in with his lawyer) to make sure that the papers were indeed filed. Bear in mind that New York City courts are especially busy and it may simply take more time to get on the court's schedule. Also bear in mind that courts are a bit slower in summer, as that tends to be a big vacation time for judges, etc.

Thanks. Just that I want this over already. I want the both of us to move on in good terms. But the more this is prolonging, the more aggravated I'm gonna get.
