I filed for divorce and my husband wouldn't leave. In my state he does not have to leave until the divorce is final UNLESS, you can prove abuse. If abuse, verbal or physical is proven then there can be a court order. I assume this varies from state to state, you might want to consult an attourney.
Has anyone here ever kicked out their husband for cheating with serious intent on divorce? How do you kick out someone who refuses to leave?
I've wanted my H to leave also but I was told by someone (sorry don't remember who it was) that since his name is also on the mortgage, I can't make him leave because he also owns our house.
IF you are going to change locks, file for divorce or something else drastic - don't forget the bank. Freeze the line of credit if possible. He may react to the changed locks by cleaning out the bank accounts and any funds he can access.
Sad truth is that without abuse that warrants a restraining order, or order of protection you cannot banish your husband from the marital home cause you want to.
Obviously the opposite is true as well. Marriage and Divorce are civil matters, not criminal. If your husband is getting his willy serviced somewhere else, he still has the right to sleep anywhere in the home you aren't sleeping, to cook on the stove, use the refridgerator, autos, etc. Anything that is community property.
IF you decide to change the locks when he is out of the house, be aware that you are committing a criminal offense, and could end up arrested for depriving him of his domicile and property, not to mention his children.
You own the property and home together until a judge says you don't. That's how divorce lawers get so rich.
