If you can work out all your issues amicably, you could try using a mediator to avoid expensive lawyers' fees? I really don't know; I just know the more you can work out yourselves without needing to get lawyers involved the better.
A lot depends on your state, which means you probably do have to see a lawyer to find out the process in your state.
